Activists and Media Misrepresent SCOTUS Decision
There’s been a continuing standoff between Texas and the federal government on how to manage the border crisis. One dimension of this conflict has been CBP agents cutting barbed wire that was installed by state officials to discourage crossing. Texas recently sued the federal government claiming that removing the wire is illegal. A lower court issued an injunction preventing CBP from cutting the wire except in cases of a medical emergency. Then last week the Supreme Court stepped in and eliminated the injunction while the case is continuing.
Nothing in the Supreme Court decision addressed what Texas can or can’t do at the border. However, many activists and some members of the press have mis-portrayed the SCOTUS ruling and wrongly asserted that Texas is defying The Supreme Court by continuing to put up wire. CNN’s Dana Bash claimed Texas “is ignoring the highest court in the land,” while PBS News suggested the Texas Governor was defying the ruling. That framing is not only factually false, but it also undermines the legitimacy of the Supreme Court by suggesting it’s being ignored.
